In a prosecution for a hate crime offense, the government must establish that the defendant committed prohibited conduct \u003Cem>because of\u003C\u002Fem> a specific protected characteristic.\u003C\u002Fp>\u003Cp>The phrase \u003Cem>because of\u003C\u002Fem> is not defined. However, since 2014, courts have generally held that \u003Cem>because of\u003C\u002Fem> relates to causation and requires the government to establish but-for causation. For example, the U.S. Court of Appeals for the Sixth Circuit held in&nbsp;\u003Cem>United States v. Miller\u003C\u002Fem> that in a prosecution for a hate crime offense, the phrase \u003Cem>because of\u003C\u002Fem> required the government to establish that but for the religion of the victims, the defendants would not have committed the assaults.\u003C\u002Fp>\u003Cp>This bill replaces the \u003Cem>because of\u003C\u002Fem> standard, which relates to&nbsp;causation, with a new standard related to motive.
